This is a simple battery case, the judge should be able to rule on this alone, and I'm surprised the judge would even entertain the idea of including a jury on this. Fine the sonofabitch, make him do community service at a battered women's shelter, and call it a day. What makes this all worse is that he's trying to weasel out of it!
